Unified Patent Court (UPC) and Patent Disputes

The Unitary Patent became a reality with effect from 1 June 2023. The Unified Patent Court (UPC) will have jurisdiction over all European patents designated to EU Member States which ratified the UPC Agreement and all unitary patents. Our attorneys advise clients on the optimal strategy to adopt between European Patents with unitary effect, validation of a European Patent or a combination.  

Historically, European patents were litigated separately in each relevant jurisdiction. That led on occasion to contradictory or, at least, inconsistent outcomes. The UPC now provides a single and centralised court of enforcement.
